Feds Dealt Quick Loss After Court Concern On ‘Noble Tradition’

A U.S. appeals court has ordered a new sentencing for an immigration defendant after chiding the Justice Department for its handling of a prosecution in which it misinformed a trial judge about the facts of the case.

At issue was a 14-month prison sentence given to defendant Yarcy Razo-Nunez. At the initial sentencing last year, a federal prosecutor said Mr. Razo-Nunez had unlawfully entered the U.S. on three occasions. In fact, he had done so twice.
