There’s an app for everything. As we all discover how effectively we can use apps to connect with social media, as our work task managers, to find user-friendly news, and much more, they begin to accumulate on our smartphones and devices. Our hosts Dennis Kennedy and Tom Mighell share tips on how to organize those apps to be the most efficient, aesthetically pleasing, and space conserving - making room for more apps. We will also learn how to sync all of their devices so that we always have access to our apps. At Trial, Witness Says Zimmerman Acted In Self-Defense

A key witness for the prosecution in the George Zimmerman trial took the stand on Friday. Neighbor John Good is the only person to have seen the fight between Zimmerman and 17-year-old Trayvon Martin. Zimmerman shot and killed Martin. Good testified it appeared Martin was on top of Zimmerman, straddling him and that Zimmerman was the person calling for help.

UN urges Iraq to address human rights abuses

[JURIST] The UN Assistance Mission for Iraq (UNAMI) [official report] released a report [text, PDF] Thursday which presses Iraqi leaders to develop measures addressing the growing trend of human rights abuses in Iraq. According to the UN, terrorist groups killed more than 3,100 Iraqi civilians and injured more than 12,100 during 2012. UNAMI stresses that these figures indicate a reversal in the reduction of violence in recent years and a growth in the use of "asymmetric tactics" deliberately targeting civilians....

‘Mt. Holly’ takes the place of ‘squelched’ St. Paul suit

In February of 2012, the city of St. Paul withdrew its appeal to the United States Supreme Court  in Magner v. Gallagher just weeks before oral argument. The case was a discrimination case under The Fair Housing Act.   Reportedly, civil rights groups pressured St. Paul  to drop the case out of fear that the disparate impact provisions in the Fair Housing Act would be weakened.

Now, the same issue is back before the high court, which yesterday accepted cert in Mt. Holly Gardens Citizens in Action v. Mt. Holly. Forbes online describes Mt. Holly as the first impact to reach the Supreme Court since the administration was accused of engineering a settlement that “squelched” the St. Paul case.

Also according to Forbes, Philadelphia lawyer John Culhane said, “The perception is the Supreme Court has taken this case because it feels there is no disparate-impact theory of liability, and is prepared to rule to that effect.” The Third Circuit ruled that plaintiffs had made a prima facie case of disparate impact.

Magner has been on hold in Minnesota federal court while the parties awaited the Supreme Court’s determination on Mount Holly.

Think Twice Before You Stick Out Your Tongue

No need to think twice about sticking out your tongue, either in the United States, or probably almost everywhere except ... Italy. You may not believe this but, as reported by UPI, "Italy's highest court of appeal affirmed the illegality of insulting someone by sticking your tongue out at them."

The case brought before the Cassation Court involved a farmer whose tongue gesture was captured by a cellphone camera held by the neighbor with whom he was arguing.
The farmer, Carlo O., had been convicted by a justice of the peace of insulting the neighbor, the Italian news agency ANSA reported.
The Cassation Court let stand the conviction and ordered Carlo O. to pay his neighbor's court costs of $1,863.81. He will also have to pay damages, which will be set in a different trial, the news agency said Friday.
Italian courts often find people guilty of offending someone's honor, ANSA reported.
Wow. And to think the U.S. insurance and business lobbies complain endlessly about frivolous lawsuits...

Private Prisons, Profits, and Prisoners’ Rights

On this edition of Lawyer2Lawyer host Bob Ambrogi discusses private prisons with Susan Herman, president of the American Civil Liberties Union (ACLU), and Adrian Moore, vice president of the Reason Foundation, a non-profit in support of libertarian principles and privatization.

Susan Herman was elected president of the ACLU in October 2008. As Centennial Professor of Law at Brooklyn Law School, she teaches courses in the area of Criminal Law and Procedure and Constitutional Law. The ACLU has been studying and protesting against private prisons as a for-profit business for decades.

Dr. Adrian Moore is vice president of policy at the Reason Foundation. He has conducted studies, written publications and scholarly articles on the privatization of prisons and how they yield quality corrections at a lower cost. Twice convicted of fraud, lawyer gives up license

A lawyer who pleaded guilty in April to taking part in two separate massive fraud schemes now has surrendered her Virginia law license.

Seung Oh Kang of Annandale – convicted under the name Sueng E. Oh – admitted taking part in a small business loan fraud scheme said to involve more than $100 million in losses to a federal program. Kang also admitted to misappropriating millions in real estate loan money in Virginia as part of an operation that produced 11 guilty pleas.

“These defendants have admitted to bilking millions of dollars from our financial institutions by falsely inflating costs of doing business while processing short sales, keeping payoffs from mortgages thought to have been refinanced, and illegally borrowing against escrow accounts of homeowners in Northern Virginia,” said FBI official Valerie Parlave when the real estate convictions were announced last month.

Kang, who had a settlement company in Annandale, pleaded guilty to charges in Maryland federal court in the small business loan scam and in Virginia federal court in connection with the real estate scam.

On June 7, the Virginia State Bar Disciplinary Board suspended Kang’s license to practice law based on her Maryland conviction.

On June 24, the board revoked Kang’s license to practice law.  In consenting to the revocation, Kang admitted that the charges against her are true and that she could not successfully defend against them, according to the VSB.

Code X: Stanford Law's Hotbed of Legal Technology Startups

The Most Unusual Criminal Gang Ever?

These women knew that they were virtually untouchable by the police. Why? Because they were pregnant (or suckling)! Per the Qianjiang Evening News (via ChinaDaily):

A group of 46 pregnant women were arrested and prosecuted for theft in Hangzhou, Zhejiang province.
The women, who committed more than 400 thefts a month in the city, vary in ages from 20 to 40. They repeatedly got pregnant, because police will not usually arrest pregnant women or women suckling. One member in the group even got pregnant eight times in 10 years.
After they were arrested, the number of robberies in the city decreased noticeably.

Complaint Alleges Former Sidley Partner Defrauded Firm

Lee Smolen, a real estate lawyer in Chicago who left Sidley Austin last fall and joined DLA Piper as a partner in February, is accused of fabricating nearly $120,000 in expenses during his final six years at the firm.

You NEVER Mess With Any Mother When Her Young Are Nearby!

If you thought The Juice was referring to an animal, you're right - a homo sapien. In the future, this dude will likely walk around the lake to avoid a mother duck and her ducklings. As reported by khou.com:

[A Baytown mother] and her sons went into the CVS in the 1500 block of North Alexander Drive [in Houston, Texas] for about 10 minutes.
When they returned to their van and she began driving away, a man suddenly appeared from the back of the vehicle.
He pulled a knife and threatened to hurt one of the children, if the woman didn’t give him $200.
Son, you picked the wrong van.
The woman punched the suspect in the mouth and grabbed his knife. After a struggle, the thug jumped out of the vehicle.
Bam!
The woman tried to drive away, but the suspect ran toward her van and she struck him with it.
Ouch.
The suspect was taken by Life Flight to Memorial Hermann Hospital in Houston. He has been identified as Ismael Martinez, 53.
And after the hospital ...
Martinez will be taken to jail when he recovers.

2 vacancies on 8th District bench

There are two judicial vacancies in the 8th District. Judge Kathryn N. Smith and Judge Jon Stafsholt retired.

Judge Smith’s seat will be chambered at Willmar in Kandiyohi County and Judge Stafsholt’s seat will be chambered in Glenwood in Pope County.

The Commission on Judicial Selection is screening applicants to find a replacement for both spots.

An individual wishing to apply may request an application by writing to Lee E. Sheehy, Chair of the Commission on Judicial Selection, at 130 State Capitol, 75 Rev. An Awful Long Time

While much of the news coverage of FBI Director Robert Mueller's Congressional hearing this week focused on his admission that the FBI has used drones domestically, there were some other points raised, including his "defense" of the broad surveillance techniques that appears to amount to the idea that it just takes too long to obey the Constitution and go through the proper procedures before getting information:
Testifying before the Senate Judiciary Committee, Mr. Mueller addressed a proposal to require telephone companies to retain calling logs for five years — the period the N.S.A. is keeping them — for investigators to consult, rather than allowing the government to collect and store them all. He cautioned that it would take time to subpoena the companies for numbers of interest and get the answers back.

“The point being that it will take an awful long time,” Mr. Mueller said.

I couldn't have said it better myself.



It's very hard to protect us and do all that constitutiony stuff.  Work, work, work. Shucks.

Law means a better life, not death

The following note is prompted by the comments of Susan Cartier Liebel of Solo Practice University®  and her post about Kimberly, a young mother who just gave birth to her third child and was a 3L law student at Stetson. She became ill but failed to go to a doctor to address her own health. She was busy with her family and "stuff."

This is for all of you out there whether lawyer or law student, mother or father, who puts
themselves last. You put off going to the doctor for that chronic cough while you rush your child to the pediatrician for a hang nail. You eat your cold dinner out of a jar standing up and talking on the phone while you make sure your child’s meal is hot and she’s seated lest she choke on her food. You do so because ‘you can handle it’. Well, here’s the truth.  You can’t.

You can’t care for your kids or your spouse if you break down physically. You can’t care for your clients if you don’t take time to reinvigorate and refresh.  Remember the airline admonition: Put your air mask on first and then help your child and others around you. None of us are superhuman or immortal. There is nothing more important than your health, no final, no brief, no exam, no trial, no event.  Remember this the next time you get no sleep or ignore that persistent cough or inexplicable pain in your side because ‘you don’t have time’ to slow down. Remember you can break down, too. No machine and certainly no human can work without stop and without repair from time to time.
