Report Examines ADA Liability in Attorney's False Arrest Suit

A prosecutor who allegedly orchestrated the arrest of a prominent attorney on extortion-related charges is potentially liable for damages under recommendations submitted by a federal magistrate judge, who found that the attorney's allegations that he was "set up" describe "investigative acts that would normally be performed by the police and for which the D.A. defendants are not entitled" to absolute immunity.
