Circuit Says Insurer Can't Shield Internal Memos Over Disputed Claim

A frequent target of suits over the handling of disability claims, Unum Life Insurance Co. of America received a blow Wednesday from the Ninth Circuit, which ruled that, because of Unum's dual role as claim administrator and payor, an employee who was denied disability benefits is entitled to discovery of memos from in-house counsel to the claims analyst handling his case.
