Wisconsin public employee collective bargaining statute amendments declared unconstitutional

A teachers' union sought declarative and injunctive relief against the governor, claiming that statutory amendments dealing with municipal employees' collective bargaining rights and payroll deductions of dues and pension contributions were unconstitutional.

The trial court declared the statute unconstitutional. Madison Teachers v. Walker (Wisconsin Circuit Ct 09/14/2012)

(1) Certain portions of the statute violated the free speech clauses of the Wisconsin and US constitutions. Although there is no constitutional right to collective bargaining, the statute imposes burdens on the speech and associational rights of employees represented by unions which burdens are not imposed on other employees. They cannot negotiate wage increases greater than the cost of living, they cannot pay dues by payroll deductions solely because the dues go to labor organizations. A ban on fair share agreements means that union members bear the cost of bargaining for non-members who receive the befits of bargaining. Requiring unions to be recertified annually burdens members with the full costs of the election.

(2) The trial court applied strict scrutiny to the equal protection claims because of the infringement on speech rights. The statute creates two classes of employees (represented and non-represented), and the defendants "offer no defense of the statute that would survive strict scrutiny."

(3) Certain portions of the statute violated the Wisconsin constitution's home rule amendment, violated the constitutional bar on impairment of contracts, and deprived employees of property without due process.

Police chief who stole drugs gets 9 years

A former small town Virginia police chief who orchestrated a drug store burglary to get pain pills has been sentenced to nine years in federal prison.

Bryan Young, chief of the Pennington Gap police department, arranged for other officers to be off duty one night last September to clear the way for associates to break into a Rite-Aid pharmacy and steal painkillers. Young later obtained some of the stolen pills.

Young was arrested in October after selling pills to an informant while wearing his police uniform, authorities said.

Young’s family members pleaded for leniency in letters to the court, noting the effect of the arrest and charges on Young’s two school-aged daughters.

“This sad case demonstrates how pervasive and dangerous prescription drug abuse can be, and how it pervades all levels of society,” said U.S. Attorney Timothy J. Heaphy in a news release.

Clerk Makes Robbery A Piece Of Cake

A convenience store clerk in Florida might as well have said "Hey fellas, want some money? Help yourself!" Here's how it went down, as reported by www.wpbf.com:

Boynton Beach police said two men entered the store [the aptly-named E-Z Market] and found the clerk asleep in the back.
Police said one of the men took between $300 and $400 from the register while the other man kept watch to make sure the clerk didn't wake up.
Both men then rode off on a bicycle, police said.
Fellow cyclists? Dagnabbit. Please, don't hold this against The Juice and the ever-increasing number of cyclists out there.

Federal prisoners can request compassionate release if they are terminally ill, but a recent investigation found that many die while their requests drift through the system. Now, prison leaders say they will simplify the approval process and start tracking requests electronically.

What's Wrong With Your Practice ... Perception or Reality?

Most of us can notice when something “isn’t right” with our bodies, and we often are quick to jump to a conclusion about the cause.  Yet what we perceive to be the problem, and the reality behind it, may be much different.

A urologist recently shared an example with me, saying that many people come to him to “fix the problem” of an over-active bladder at night.  They typically attribute it to a “plumbing” issue that a pill or even surgery can cure.  Yet this doctor suggested that, as people age, they sleep less and they’re likely to be awakened more easily by sounds that didn’t disturb them in earlier years – a dog barking, the house creaking.  Once they’re awake, they decide to honor the bladder urge so they can go back to sleep. The perception is that there is a physical medical problem.  The real cause is the natural aging process and the best “cure” is to accept it.

Transfer this lesson to a law practice.  Most lawyers are quick to perceive a problem when there is less money coming in the door.  They immediately jump to a conclusion about “the cure” – do more marketing, or raise rates.  The reality is that declining revenue typically began long before as a problem with receivables.  Generating new work to cover declining revenue simply isn’t the answer.  The strategy is to make sure clients know they must pay their bills within 30 days.  And the way to do that is specify clear collection terms in the engagement agreement. Lawyers perceive every client as valuable and hate to cut them loose; the reality is that continuing to do work for overdue clients who don’t pay shows those clients are not worth keeping.

A new study by George Washington Law School showed that realization rates (the amount of money billed that is collected) average 83.6 percent for all law firms, a figure that is a historic low.  If you perceive your revenue is down, and the reality is that you only collect 80 cents on the dollar, you’re like the urologist’s patients – you won’t get many good nights of sleep.

The Family That Drinks Together ...

Well, yes, the family that drinks together often does get drunk together. And they do stick together too. As reported by timesonline.com (Beaver, PA):

Rochester police said [Jason Dean] Sheets [25] Sheets and John William Moore Jr., 47, also of 300 Jackson St., Apartment 31, were pumping gas at Sheetz on Adams Street on May 1 when they began harassing a young black man in the store. The two men followed the man out of the store and an argument started, police said.
Not cool.
When officers arrested Sheets, he began to struggle, yell and swear at them, the police report said. Once inside the police car, Sheets tried to kick out the windows and slammed his head against the glass partition, police said.
And mom just stood by and ... no?
[Annette Marie] Davis [44], who is Sheets’ mother, became irate during the arrest and also began to struggle with police and kick them in the legs.
Yikes. The charges?
Davis ... is charged with two counts of aggravated assault, and one count each of resisting arrest, disorderly conduct and public drunkenness.
Sheets ... is charged with two counts of aggravated assault, and one count each of resisting arrest, disorderly conduct and public drunkenness.
What about Mr. Moore?
Moore, who was driving the vehicle Sheets and Davis were riding in, was charged with drunken driving.

Do not read this within 30 minutes of eating. It's gross. It's about diarrhea. As reported by Syracuse.com, there was a dispute between two roommates about said diarrhea.

Palmieri, 59, was suffering from severe diarrhea March 10 in the apartment he shared at 473 Pleasantview Ave. with David Utt, 62, according to a Syracuse police report.
"I asked him to use the bathroom fan so that it wouldn't smell up the house," Utt said in a written statement. The request upset Palmieri.
Seems like a reasonable request to The Juice.
"Thanks for the sympathy," Palmieri said, according to Utt.
"It's common courtesy," Utt replied.
Uh-oh.
Palmieri then vowed to "crap all over the house, the bathroom and my car," Utt told police.
Oh it's on.
Palmieri got into his pajama bottoms, then went outside, Utt told police. Utt was suspicious because Palmieri doesn't smoke.
During the night, Utt discovered Palmieri had defecated "all over the floor in the bathroom and in the hallway near the bathroom," Utt's statement said.
The next morning, Utt opened the door to his 1997 Lincoln and saw "that Palmieri had, in fact, defecated over the back seat of his car, on the leather seats," a police report said.
Utt had to drive the feces-laden car because he had to get to a doctor's appointment that morning, he said. When he got home, he gave Palmieiri five minutes to start cleaning it all up.
Yeah. Think that happened?
"How does it feel to be (expletive) on?" Palmieri asked, Utt told police. Then Palmieri punched him in the face, Utt said.
So you shit all over the place, and then you punch him in the face?
Utt told police he doesn't know how much it will cost him to have the car professionally cleaned, the report said.
Just junk it pal. You're wasting your time.
Palmieri told police in a phone interview that he didn't want to give his version of the story or return to the scene, "adding that he has diarrhea," said the report written by Officer Shawn Prue.
The Juice hopes the new roommate has a bad sniffer. The charges?
Palmieri was charged with second-degree harassment and fourth-degree criminal mischief.
